This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from Island Viewpoint, LLC for a modification of Shore Protection Act (SPA) Permit #451 under Official Code of Georgia (O.C.G.A.) 12-5-230 et. seq. for the modification of the building footprint, masonry screen wall, driveway/parking, pool, and pool deck; construction of a property fence; installation of a FCD double check valve, a post indicator valve, and temporary construction and silt fencing; and landscaping within the State’s SPA Jurisdiction, at 1124 Postell Avenue, St. Simons Island, Glynn County, Georgia.

SPA Permit #451 was issued on February 24, 2017 to TerraCap, LLC. On September 5, 2018, the permit was transferred to Island Viewpoint, LLC. The permit authorizes the demolition of the existing house, removal of the brick deck and second story wood deck, the construction of a 6-unit Condominium building, driveway, pool, pool deck, masonry wall, and landscaping. The existing home at the site has been demolished and the 6-unit condominium building, authorized under SPA Permit #451, is currently under construction at the site.

The applicant’s property is approximately 13,987 sq.ft. (0.321 acres) of which 6,618 sq.ft. (0.152 acres) is located within the State’s SPA jurisdiction. The applicant proposes to make modifications to the previously approved items under SPA Permit #451. The previous building footprint was 2,371 sq.ft. The overall condominium footprint will be a smaller area, 2,150 sq.ft. (a decrease of 221 sq.ft.). The proposed modification to the authorized masonry screen wall to be located at the front of the property is a gate for fire department access and added square pilasters for appearance, 41 sq.ft. (an increase of 1 sq.ft.). The driveway and parking have been reduced in size from 99 sq.ft. to 88 sq.ft. The proposed modifications to the pool and pool deck area create a larger footprint, 1,182 sq.ft. (an increase of 103 sq.ft.). The proposed modification also includes the addition of a permanent fence (64 sq.ft.) to be constructed along the property perimeter and around the pool. A fire department check valve and post indicator valve, as required by Glynn County, are proposed and will be installed in one of the non-native landscaped beds. The non-native landscaped beds will total 670 sq.ft. (an increase of 245 sq.ft.).

The proposed modification also includes the installation of temporary construction and silt fencing around the site as needed during the construction period. Landscaping modifications within jurisdiction include the proposed construction of a grass swale within the lawn area to meet Glynn County site drainage requirements and several new native trees including a live oak tree to meet the Glynn County tree ordinance. A landscape plan has been provided to the Department for review. The lawn area, native landscape areas, and grass swale will total 2,423 sq.ft. (a decrease of 181 sq.ft.).

As proposed, the total jurisdictional impacts of the proposed hardscape would be approximately 4,195 sq.ft. (63.4%), which is an increase of 181 sq.ft. from the previously authorized 4,014 sq.ft. Approximately, 2,243 sq.ft. (36.6%) of the State’s jurisdictional area will be retained or improved to a more natural vegetated and topographic state, which is a decrease of 181 sq.ft. from the previous 2,604 sq.ft.

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations:  (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand-sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
