This serves as notification from the Coastal Marshlands Protection Committee and the Georgia Department of Natural Resources of a request from the Georgia Department of Natural Resources for a Coastal Marshlands Protection Act (CMPA) Permit under O.C.G.A. 12-5-280 et. seq. to modify and maintain an existing public facility at Fort McAllister State Park, Redbird Creek, Bryan County, Georgia. The proposed modification is less than 1/10 of an acre and is considered a minor alteration of coastal marshlands under O.C.G.A. 12-5-280 et. seq.

The existing public facility was authorized under Coastal Marshlands Protection Act Permit #289. The existing public facility consists of a 22ft. x 100ft. boat ramp that is serviced by an 8ft. x 90ft. walkway, an 8ft. x 60ft. fishing pier, a 4ft. x 26ft. ramp and an 8ft. x 135ft. floating dock. The structure extends approximately 100ft. into Redbird Creek at a point where the creek is approximately 352ft. from Mean Low Water (MLW) to MLW. Total impacts to jurisdictional coastal marshlands of the existing project is approximately 4,584sq.ft. (0.11 acre).

The applicant is proposing to modify the existing public service dock by constructing and maintaining a 4ft. x 34ft. ramp that will provide access to a proposed 8ft. x 140ft. floating dock. No modification to the existing boat ramp is proposed. Impacts for the proposed structure total approximately 1,256sq.ft. (0.03 acre). Total impacts for the existing and proposed structures would total 5,840sq.ft. (0.14 acre). 

The applicant has stated that the proposed project does not contain an upland component. 

It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. Impacts to coastal marshlands must be minimal in size. In passing upon the application for permit, the Coastal Marshlands Protection Committee shall consider the public interest: (1) Whether or not unreasonably harmful obstruction to or alteration of the natural flow of navigational water within the affected area will arise as a result of the proposal; (2) Whether or not unreasonably harmful or increased erosion, shoaling of channels, or stagnant areas of water will be created; and (3) Whether or not the granting of a permit and the completion of the applicant’s proposal will unreasonably interfere with the conservation of fish, shrimp, oysters, crabs, clams, or other marine life, wildlife, or other resources, including but not limited to water and oxygen supply.
